This policy explains how Gower Capital Group Ltd ("we", "us") collects and uses your personal information when you apply for housing with us through our Gower Living and Gower Capital Property Group websites, and your rights under the UK GDPR and the Data Protection Act 2018.

The information we collect

When you complete an application we collect: your name, date of birth, contact details and National Insurance number; next‑of‑kin details; your current housing situation and history; benefits, income and Managed Payment preferences; references; and information about your support needs.

Some of this is special category data (information about your health, including mental health) and criminal offence data (convictions, probation and licence information). We only collect this where you provide it, to assess a suitable and safe placement.

Why we use it and our lawful basis

• To assess and process your application and, if successful, enter an occupation contract — UK GDPR Article 6(1)(b) (steps prior to a contract) and 6(1)(f) (our legitimate interest in assessing suitability and managing our housing safely).
• To meet our legal duties as a landlord (e.g. the Renting Homes (Wales) Act 2016, safety and licensing obligations) — Article 6(1)(c).
• Health information — we rely on your explicit consent (Article 9(2)(a)), which you give on the form and can withdraw at any time.
• Criminal offence information — processed under the Data Protection Act 2018 (Schedule 1) for the purposes of assessing suitability and safeguarding, supported by our retained policy document.

Who we share it with

We share information only where necessary with: your referring organisation (e.g. local authority housing options or support teams); support providers and probation services involved in your care; Rent Smart Wales and local authorities where required; the Department for Work and Pensions (for Universal Credit Managed Payments); an approved tenancy deposit scheme; and our service providers who host the website and send our email notifications. We do not sell your information.

How long we keep it

We keep successful applicants' information for the duration of the occupation contract and for up to six years afterwards to meet legal and accounting requirements. Unsuccessful applications are kept for up to 12 months and then securely deleted.

How we protect it

Your information is stored securely and access is restricted to the housing team. Our website uses encrypted (HTTPS) connections.

Your rights

You have the right to access your information; to have it corrected or erased; to restrict or object to its use; to data portability; and to withdraw consent at any time. To exercise any of these, contact mail@gowercapitalgroup.com.
